Section I: General Community Rules & Etiquette

Thank you for being part of our community. To ensure the best possible experience for all members, we have established some basic guidelines for participation.

By joining and using this community, you agree that you have read all sections and will follow these rules and guidelines. You also agree to reserve discussions and shared files and content that are best suited to the medium. This is a great medium with which to solicit the advice of your peers, benefit from their experience, and participate in an ongoing conversation. Questions should be directed through the Contact Us link on this site.

Please take a moment to acquaint yourself with these important guidelines. In order to preserve a climate that encourages both civil and fruitful dialogue, we reserve the right to suspend or terminate participation in this community for anyone who violate these rules.

The Rules

  • Don't challenge or attack others. The discussions and comments are meant to stimulate conversation not to create contention. Let others have their say, just as you may. 

  • Don't post commercial messages on any discussion list, resource library entry, or other area where others might see it. Contact people directly with product and service information if you believe it would help them.

  • Use caution when discussing products. Information posted on the lists and in the libraries is available for all to see, and comments are subject to libel, slander, and antitrust laws. 

  • All defamatory, abusive, profane, threatening, offensive, or illegal materials are strictly prohibited. The posting of it may result in immediate termination and/or criminal prosecution. Do not post anything that you would not want the world to see or that you would not want anyone to know came from you. 

  • Please note carefully all items listed in the legal statement and privacy policy in Sections II & III below. By making content available, you represent and warrant that you do not infringe on proprietary rights and you have the authority to post such content on our site. 

  • Even though the communities are closed groups, they are not private! That means anyone can copy conversations, take screenshots, or duplicate messages that appear on a community.

  • Post your message or documents only to the most appropriate lists or libraries. Do not spam several lists or libraries with the same message.

  • All messages must add to the body of knowledge. We reserve the right to reject any message for any reason.

     


    Discussion Group Etiquette

  • Include a signature tag on all messages. Include your name, affiliation, location. 

  • State concisely and clearly the topic of your comments in the subject line. This allows members to respond more appropriately to your posting and makes it easier for members to search the archives by subject. 

  • Include only the relevant portions of the original message in your reply. Delete any header information, and put your response before the original posting. 

  • Only send a message to the entire list when it contains information that everyone can benefit from. 

  • Send messages such as "thanks for the information" or "me, too" to individuals--not to the entire list. Do this by using the "Reply to Sender" link to the left of every message.

  • Do not send administrative messages, such as “remove me from the list”. Instead, use the web interface to change your settings or to remove yourself from a list. If you are changing e-mail addresses, you do not need to remove yourself from the list and rejoin under your new e-mail address. Simply change your settings.

            Welcome to the website (the “Site”) of The National Association for Music Education, Inc. (“NAfME” “we” or “us”). This Terms of Use page describes the terms upon which you may access and use our Site. In consideration of your use of the Site, you agree to NAfME’s Privacy Policy and the following Terms of Use. Additionally, by visiting our Site, you affirm that you have read and accept all of the following Terms of Use. We may change or update this Terms of Use Page without notice, so we encourage you to review it periodically.

            We reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users, including registered users.

            We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms of Use.

1. Access to Site from Outside the U.S and Consent to Transfers to U.S. of Personal Information for Other Countries.

            The owner of the Website is based in the Commonwealth of Virginia in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

           The servers NAfME uses to collect and store information reside in the United States. Thus, by voluntarily providing information through the Site or other medium, you consent to the transfer of your information, including personal information to the United States.

2. Ownership of Copyrights, Trademarks and Other Intellectual Property. You acknowledge that NAfME owns the copyright and all other intellectual property rights to this Site and all content, materials and information provided on this Site unless otherwise expressly indicated. All content on this Site is protected by U.S. and international copyright, trademark and other laws. All rights are reserved by NAfME, and you agree not to copy, reproduce, download, disseminate, publish, or transfer content in any form or by any means, except with our prior written permission, or as permitted by us in a separate written agreement. Any unauthorized use is strictly prohibited.

            NAfME’s name and logo are service marks of NAfME. References on our Site to any specific organization or its products and services by name or otherwise do not constitute or imply endorsement, recommendation, or favoring by NAfME and you may choose to use products or services other than those referenced by NAfME.

3. Rules for all Users. When accessing or using this Site or posting comments to our blog, discussion boards, or other online forums you agree to the following rules/restrictions and acknowledge that a violation of any of them constitutes grounds for immediate termination of your access to our blog discussion boards, or other online forums without further notice, in our sole discretion:

        a.  You will not engage in fraudulent activity of any kind, including by forging information, impersonating other people, contributing information which you know to be false, misleading, inaccurate or incomplete, or misrepresenting your affiliation with any person or entity.

        b.  You will not use the Site in any manner that may be considered objectionable, such as by using the Site to upload, post, display, or otherwise transmit any content that is false, unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, pornographic, libelous, criminal or invasive of another’s privacy.

        c.  You will not violate or attempt to violate the security of the Site, use any device, software or routine to interfere or attempt to interfere with the proper working of the Site, or take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Violations of this sort will be prosecuted to the fullest extent of state and federal laws.

        d.  You will not launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” or other mechanisms, that access the Site in a manner that sends more request messages to our servers in a given period of time than can reasonably be produced by an individual in the same period using a conventional on-line web browser.

        e.  You will comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Site and will not use the Site for unlawful purposes.

        f.  You will not post, upload, email, link to, or otherwise transmit any content that contains any viruses, cancel bots, Trojan horses, harmful code, or other computer software or program designed to interrupt, destroy or limit the functionality of the Site or impair others’ ability to enjoy the Site, or the proper functioning of any software or hardware or equipment or materials used in connection with the Site.

        g.  You will not infringe, misappropriate, or otherwise violate any existing local, national or international copyright, trademark, service mark, trade name, patent, right of publicity or privacy, or other intellectual property or proprietary rights of any person or entity whatsoever.

        h.  You will not give your password to anyone, use the Site as the agent of a third party, or allow any third party to use your account. If any security breach or unauthorized use of your account occurs, you will notify NAfME immediately in writing or via email. You are solely responsible for maintaining the confidentiality of your username and password and are responsible for any unauthorized use.

        i.  You will use the Site solely for your personal, noncommercial use.

4. Submissions. We have the right to remove or refuse to post any submissions for any reason or no reason in our sole discretion. We also have the right to take any action with respect to any submission that we deem necessary or appropriate in our sole discretion, including if we believe that such submission violates the Terms of Use, infringes any intellectual property right or other right of any person or entity, or could create liability for the NAfME. In our sole discretion, we may disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.

By submitting any content or other information to the Site for publication on the Site or elsewhere by NAfME, you also agree to the following terms. You shall be solely responsible for your submission of content to the Site and the consequences of posting or publishing it. You understand that whether or not such content is published, NAfME does not guarantee any confidentiality with respect to any submissions. In connection with any and all content that you submit, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize NAfME to use and allow others to use such content in the manner contemplated by these Terms of Use; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the content to use his/her name or likeness to enable inclusion on the Site. While you retain all of your ownership rights in the content that you submit, by submitting such content to the Site, you hereby grant NAfME a worldwide, non-exclusive, royalty-free, perpetual, sublicenseable and transferable license to use, reproduce, distribute, modify, prepare derivative works of, display, and perform the content that you submit, in connection with the Site and NAfME’s mission, including without limitation for promoting and redistributing part or all of the content (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Site a non-exclusive license to access and view content submitted by you as permitted through the functionality of the Site and under these Terms of Use.

NAfME is not obligated to review material before it is posted on the Site, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.

5. Privacy. Please see our the Privacy Policy (Section III below) for further details concerning our website privacy practices.

6. No Effect on Agreements. The information provided on the Site is for general informational purposes only, and nothing on our Site shall be construed to add or modify terms to any existing or future agreements with NAfME.

7. Other Websites. In addition, solely as a courtesy to you, we may provide links to other websites and resources at certain places on our Site; we do not endorse, approve, certify or control websites that are not programs of NAfME. Because we do not have any control over such sites, you acknowledge and agree that we are not responsible for the content of the sites or the availability, accuracy, completeness, efficacy, or timeliness of information contained on those sites. Use of those sites or any information obtained from those sites is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy and timeliness.

8. Disclaimer of Warranty. While we make every effort to present accurate and reliable information on our Site, we do not guarantee the accuracy, completeness, efficacy, timeliness, or correct sequencing of such information. In addition, we have no duty to update the information contained on our Site, and we are not liable to you for outdated or incorrect information contained herein. Moreover, we reserve the right at any time to modify, suspend or discontinue the Site, or any part thereof, with or without notice, and we are not liable to you or any third party for any modification, suspension or interruption in services. 9. Limitation of Liability. IN NO EVENT SHALL NAfME BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE OR LOSS OF USE, ARISING OUT OF YOUR USE OF THIS SITE, EVEN IF NAfME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification. You agree to indemnify and hold harmless NAfME, its officers, directors, agents and employees from any claims, losses, liability costs and expenses (including, but not limited to attorneys’ fees) arising from your violation of these Terms of Use, state or federal laws or regulations or any third party rights, including, but not limited to, claims of copyright infringement, defamation, harassment, invasion of privacy or fraud.

11. Term & Termination. These Terms are effective upon your accessing the Site and shall continue in full force until terminated. In its sole discretion and without notice, and at any time and for any reason, NAfME reserves the right to: (a) cancel your user account; (b) terminate or suspend your access to any restricted portion of the Site; and/or (c) remove or disable your access to any restricted portion of the Site. Upon termination or suspension, your username and password will be immediately deactivated, and you will no longer have access to the relevant portions of the Site.

12. Governing Law/Jurisdiction/Waiver of Jury Trial/Arbitration. Any dispute with respect to our Site shall be governed by the laws of the Commonwealth of Virginia, excluding its conflicts of laws rules. Except as set forth below with respect to arbitration, all visitors to our Site submit to the exclusive jurisdiction of the state and/or federal courts of the Commonwealth of Virginia. Either party may enforce a judgment rendered by such court in any court of competent jurisdiction, and NAfME may seek injunctive or other equitable relief in any jurisdiction in order to protect its intellectual property rights. ALL PARTIES HEREBY WAIVE THEIR RIGHT TO TRIAL BY JURY WITH RESPECT TO ANY DISPUTE ARISING FROM THE USE OF THE SITE. 

 

Disputes arising from the use of the Site and these Terms of Use, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, shall be settled by binding arbitration under the Commercial Rules of Arbitration of the American Arbitration Association applying Virginia law, except that claims for equitable relief shall exclusively be resolved in a state or federal court within the Commonwealth of Virginia.

13. Notices. In our discretion, we may provide notices of changes to these Terms of Use or other matters by displaying notices or links to notices generally on our Site.

14. Making Donations to NAfME. We can only accept donations from individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, minors under the age of 18 cannot make donations without the prior written consent of a parent or legal guardian. By visiting this Site and/or making any donations through this Site, you represent to us that you can form legally binding contracts under applicable law, and that any and all data you have provided, or will provide, to us via this Site, such as your name, address and billing information, is complete and accurate.

15. Entire Agreement. The Terms of Use and] our Privacy Policy constitute the sole and entire agreement between you and NAfME with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Site.

16. Miscellaneous. You will not assign or sublicense these Terms of Use or any of your rights and obligations hereunder, without the express written consent of NAfME, which may be withheld in its sole discretion. Subject to the foregoing, these Terms of Use will inure to the benefit of, and will be binding upon, the parties, their respective successors and permitted assigns. If any provision of these Terms of Use is deemed by a court of competent jurisdiction to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remainder of these Terms of Use will not be affected. Such provision will be deemed modified to the minimum extent necessary to make the provision consistent with applicable law and, in its modified form, the provision will then be enforceable and enforced. The waiver or failure of any party to exercise rights under these Terms of Use will not be deemed a waiver or other limitation of any other right or any future right. Any waiver must be in writing and signed by the party to be charged therewith. These Terms of Use contain the entire agreement between you and NAfME regarding the use of the Site.

 

Section III: Privacy Policy

Privacy Policy

The National Association for Music Education, Inc. (“NAfME,” “we” or “us”) is concerned about your privacy and the confidentiality of information shared with us, including through our website (the “Site’). Because we want visitors to the Site to know how we collect, use, share, and protect the information we collect, we have developed this privacy policy (“Privacy Policy”).

This Privacy Policy applies to activities of NAfME and to persons visiting the Site, signing up for NAfME publications and mailings, or entering into transactions with the NAfME, and covers the collection, use, storage and disclosure of information and data as described in this Privacy Policy.

By accessing or using the Site and/or providing any personal information to us, you are accepting the practices described in this Privacy Policy. If you do not accept these practices, you must not access or use the Site or provide us with your personal information. We may change or add to this privacy policy, so we encourage you to review it periodically. If we use any of your personal information in a manner that you believe is inconsistent with this Privacy Policy, please contact us at the address below so that we may correct such inconsistency.

Consent to transfer personal information to the United States

If you reside outside of the United States, your personal information will be transferred to the U.S. and processed and stored in the U.S. By accessing or using the Site, or providing any personal information to us, you are accepting the practices described in this Privacy Policy and the Website Terms of Use (Section II) and consent to the transfer, processing, and storage of your personal information in the U.S.

What information does the Site collect and how is the information used?

Personal information is data that can be used to identify or contact an individual. You do not have to provide any personal information to read the content of our Site. However, you will provide personal information when submitting a donation, signing up to attend an event, applying to become a member, creating an NAfME account, submitting a post to our discussion board or other online forum, or contacting us for more information. Some examples of personal information we collect include: your name, mailing address, e-mail address, and phone number. When you make a donation or sign up for an event, we ask for your name, address, e-mail address, phone number, and credit card information (i.e., card type, number, security code and expiration date). Credit card payment processing is handled for us by a third-party vendor and is subject to the third-party’s privacy policy. Credit card information provided to us by the third-party payment processor is altered in a manner which allows us to maintain a record of the transaction, but protects the credit card number, and is stored in a secure location for a period of three months.

We use your personal information for our internal business operations, such as to process your donation, provide our programs and services, and/or to respond to your request for information. We may also use the information to contact you if there is a problem with your donation, for feedback on our services and/or to contact you for marketing purposes. For example, you may receive periodic e-mails, direct mailings or telephone calls from us with information on our upcoming events. If you do not wish to receive such e-mails, mailings or calls, please let us know by sending an e-mail to the address below or click “unsubscribe” as instructed in any email from us.

NAfME protects the confidentiality of its donors, and we never sell information about our donors. We honor all requests by donors who wish to remain anonymous. Unless a donor specifically requests that he or she remain anonymous, donors’ names may be identified in our publications.

We are the sole owner of any and all information collected through the use of the Site.

Do we collect information from children under age 13?

Our website is intended for a general audience and is not directed to children under the age of 13. We do not knowingly collect personal information from children under the age of 13. Please contact us at memberservices@nafme.org if you suspect that we have collected information from children under the age of 13. If we learn that we have collected the personal information of a child under 13 without verifiable parental consent, we will take steps to delete the information as quickly as possible.

Does the Site use cookies or tracking technology?

NAfME’s website uses cookies and other technologies for the purposes explained below. We treat information collected by cookies and other technologies as non-personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

Cookies are text files containing small amounts of information that are placed on your device’s browser that are used to help the Site recognize your browser in the future and to track your interaction with the Site. Cookies are stored on your device or in local storage. Cookies are useful because they make using the Internet easier by, among other things, saving your passwords and preferences for you. Some cookies (“session” cookies) expire and are automatically deleted when you close your browser, while others (“persistent” cookies) do not expire and are not automatically deleted. We may use cookies for these or other purposes, including to deliver content specific to your interests, to track and analyze Site usage and browsing activity, and to make your visit to the Site easier by recognizing you when you return. You can enable your browser to refuse cookies, but certain features of the Site may not work as intended or may be slowed if you decline to accept cookies.

We may also use web beacons, clear gif technology, action tags or other technologies to collect aggregate Site visitation data by tracking how users navigate to and through the Site. We may also use this technology to track the delivery of HTML email messages. Web beacons cannot be declined when delivered using a regular web page, but they can be refused when delivered by email. If you do not wish to receive web beacons by email, you will need to disable HTML images or select text only for emails received with your email software.

We may also track activity on our Site using log files stored on our servers, and collect information, including IP addresses, browser types and versions, geographic information, pages viewed and devices used to interact with the Site. We may use this information to personalize your experience and to administer our Site.

Some web browsers may transmit “do not track” signals to the websites with which the browser communicates. There is no standard that governs what, if anything, websites should do when they receive these signals. We do not currently take action in response to these signals. We may revise this policy if and when a standard for responding to these signals is established.

We may monitor email correspondence and telephone calls to track reported problems and to ensure quality assurance. Similarly, we monitor web traffic in the aggregate for the purposes of evaluating marketing campaigns and content improvement.

We may use a web analytics service, such as Google Analytics, to record and analyze your activity on this Site. The Site or any such service may track your browsing across web sites that use the same service and may collect demographic data, including the type of computer or operating system, location of user (e.g., city, state, country) and gender.

Our Site may include social media features such as the Facebook “like” button, widgets or interactive mini-programs that run on our Site. These features may collect your IP address, browsing information and may set a cookie to enable the feature to function properly. Your interactions with these features are governed by the privacy policy of the party providing it.

To whom do we disclose information?

The information that we collect is generally used for internal purposes such as fulfilling your requests for information, processing your transactions, compiling usage statistics regarding the Site, and analyzing visitor preferences regarding our services and events. Except as provided in this Policy, we will not knowingly sell, share or rent your personal information to any third parties without your permission. We may, however, share the information collected on the Site with outside parties to the extent necessary to fulfill your requests for information or to provide our services to you. For example, we use third party services to assist us in securely processing your credit card orders/donations. We may also share personal information and non-personally identifiable information with third parties that help manage and maintain our website and databases and with third-parties who assist us with direct mailing, email communications, and general business operations. We strive to ensure that any such parties will provide at least the same level of protection as this Privacy Policy offersHowever, we are not responsible for the privacy practices of third parties and do not guarantee that these third parties have similar privacy practices.

We will divulge personal information to courts, law enforcement and other governmental agencies and third parties when required to do so or when we in good faith believe it is necessary in order to comply with legal obligations

In the event that this Site or substantially all of our assets are acquired, merged or reorganized, user information may be transferred to another party.

NAfME shares or rents lists containing the names, job title, institution, and mailing addresses provided by visitors to the Site and provided through other means to a third party which may use the lists for marketing purposes. We do not share email addresses with third parties. You may request that NAfME not provide your mailing information to third parties for their marketing purposes by sending a written request to the mailing address or the email address listed below.

What are the privacy policies of linked sites and other third parties?

The NAfME Site contains links to other sites. This Privacy Policy only addresses the use and disclosure of information we collect from you. Although you may link to other sites or third parties via the Site, we are not responsible for the privacy practices of third parties or the content of linked sites that are not programs of NAfME. We encourage our website visitors to be aware when they leave our site and to read the privacy policies of each and every website that collects personally identifiable information.

Who may see the information I post to various areas of the NAfME site?

You also may provide information to be published or displayed on NAfME’s blog, discussion boards, online forums, online communities, or other public areas of the website, or transmitted to other uses of the website or third parties (collectively, “User Contributions”). You provide User Contributions and transmit them to others at your own risk. We cannot control the actions of other users of the website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

How can you access or correct your information?

You may view, correct or update the personal information we have about you by sending a request to the mailing address or the e-mail address listed below. Individuals with a NAfME account may correct or update the personal information within the NAfME system by logging into their account. If you do not have an NAfME account, and would like to correct or update your personal information, please contact us at the mail, email or telephone contact information below.

How may this privacy statement be amended?

From time to time, we may make changes to our information practices or alter the functionality of the Site.
